1. Introduction

These Terms and Conditions govern the use of the Cheltenham Vehicle Buyers website, our vehicle valuation service and the process of selling a vehicle to us.

By using our website or requesting a vehicle valuation, you agree to the terms relating to those services.

A vehicle purchase is subject to a separate agreement between you and Cheltenham Vehicle Buyers.

About Us

Cheltenham Vehicle Buyers is a vehicle-buying business operating in Cheltenham, Gloucestershire.

Trading name: Cheltenham Vehicle Buyers

Email: sell@cheltenhamvehiclebuyers.co.uk

Throughout these Terms and Conditions, references to “we”, “us” and “our” mean Cheltenham Vehicle Buyers.

References to “you” and “your” mean the person using our website, requesting a valuation or selling a vehicle to us.

2. Vehicle Valuations

We provide vehicle valuations based on information supplied by customers and, where available, information obtained from third-party vehicle data services.

Valuations may consider:

  • Vehicle make, model and specification.
  • Age and registration date.
  • Mileage.
  • Mechanical and cosmetic condition.
  • Service and maintenance history.
  • MOT history.
  • Previous accident damage.
  • Insurance write-off history.
  • Outstanding finance.
  • Current market conditions.
  • Vehicle demand and resale potential.

2.1 Indicative valuations

Any valuation provided through our website, by email, by telephone or through another communication method is indicative unless we expressly confirm otherwise in writing.

An indicative valuation does not constitute a binding offer to purchase your vehicle.

All valuations are subject to verification of the vehicle’s details, history and condition.

2.2 Accuracy of information

We ask that you provide accurate and complete information about your vehicle.

This includes disclosing any known:

  • Mechanical or electrical faults.
  • Accident damage.
  • Insurance write-off history.
  • Outstanding finance.
  • Modifications.
  • Mileage discrepancies.
  • Missing documentation.
  • Warning lights or dashboard faults.
  • Previous commercial use.
  • Significant cosmetic damage.

You should also disclose any other information that you reasonably believe could materially affect the vehicle’s value.

If information is inaccurate or incomplete, we may revise or withdraw an indicative valuation.

2.3 Changes to valuations

The final purchase price may differ from an earlier valuation where an inspection or further information identifies material differences in the vehicle’s condition, history or specification.

We will explain the reasons for any revised offer.

You are under no obligation to accept a revised valuation.

3. Vehicle Eligibility

We may decline to purchase a vehicle for legitimate commercial, legal or safety reasons.

These may include circumstances where:

  • The seller cannot demonstrate their authority to sell the vehicle.
  • The vehicle is recorded as stolen.
  • The vehicle has undisclosed outstanding finance.
  • There are material discrepancies in the vehicle’s identity or documentation.
  • The vehicle’s condition differs significantly from the description provided.
  • The vehicle presents significant safety or mechanical concerns.
  • We cannot reasonably establish the vehicle’s ownership or history.

We may consider vehicles with existing damage, mechanical faults, previous insurance write-off classifications or other issues.

However, these circumstances must be disclosed and may affect the price we are willing to offer.

We do not guarantee that we will purchase every vehicle submitted for valuation.

4. Vehicle Inspections and Appointments

We may arrange an appointment to inspect a vehicle before agreeing to purchase it.

Inspections may take place at a mutually agreed location.

4.1 Inspection process

During an inspection, we may:

  • Examine the vehicle’s exterior and interior.
  • Check its mechanical and electrical condition.
  • Verify its registration and identification details.
  • Review relevant documentation.
  • Check for previously undisclosed damage.
  • Conduct a reasonable test drive, where appropriate and legally permitted.

Any test drive will be subject to appropriate insurance and the vehicle being legally permitted and safe to use on the road.

4.2 Final purchase price

Following the inspection, we may make a final offer to purchase the vehicle.

The final offer may be higher or lower than an earlier indicative valuation.

We will communicate the proposed purchase price before proceeding.

You are free to decline the offer.

4.3 No obligation to proceed

Arranging or attending an inspection does not require either party to complete a vehicle sale.

Until a binding purchase agreement has been entered into, either party may decide not to proceed.

5. Seller Responsibilities

When selling a vehicle to Cheltenham Vehicle Buyers, you must have the legal right and authority to sell it.

You must not knowingly provide false or misleading information about the vehicle.

5.1 Ownership and authority

By entering into a vehicle purchase agreement, you confirm that:

  • You are the legal owner of the vehicle or have authority from the legal owner to sell it.
  • You have disclosed any outstanding finance or third-party interests.
  • You have disclosed any known circumstances that materially affect your right to sell the vehicle.
  • The vehicle and documentation have not been knowingly misrepresented.

A V5C registration certificate does not, by itself, establish legal ownership.

We may request reasonable additional evidence of ownership or authority before proceeding.

5.2 Vehicle condition and history

You must answer our questions about the vehicle honestly and to the best of your knowledge.

Where you are uncertain about its history or condition, you should tell us rather than make an assumption.

We do not expect private sellers to have specialist mechanical knowledge or to guarantee that a vehicle is free from defects of which they are unaware.

However, deliberate concealment or misrepresentation of material information may affect our rights under the purchase agreement and applicable law.

6. Documentation and Handover

Before completing a vehicle purchase, we may request the following items where applicable:

  • V5C registration certificate.
  • Vehicle keys and spare keys.
  • Service history and maintenance records.
  • MOT documentation, where available.
  • Locking wheel nut key.
  • Relevant vehicle manuals.
  • Information required to verify ownership or authority to sell.
  • Bank details for payment.

We will explain any required documentation before completing the purchase.

6.1 Missing documentation

If documents or items are missing, we may:

  • Proceed with the purchase at an agreed price.
  • Make a revised offer.
  • Delay completion while the information is obtained.
  • Decide not to proceed.

Any changes to the agreed transaction must be accepted by both parties.

6.2 Personal belongings

You are responsible for removing your personal belongings before handing over the vehicle.

You should also remove personal information stored in vehicle systems, where possible.

This includes:

  • Saved telephone contacts.
  • Paired mobile devices.
  • Navigation destinations.
  • Garage door access settings.
  • Personal accounts linked to the vehicle.

If we discover personal belongings after collection, we will take reasonable steps to contact you and arrange their return.

We will not intentionally dispose of identifiable personal belongings without providing a reasonable opportunity for collection, except where immediate disposal is reasonably necessary for safety or legal reasons.

7. Outstanding Vehicle Finance

If your vehicle is subject to an outstanding finance agreement, you must disclose this before completing the sale.

You must provide accurate information about the finance provider and outstanding balance.

We may agree to purchase a vehicle subject to finance where suitable arrangements can be made to settle the outstanding balance and obtain clear title.

Any such arrangements must be documented and agreed before completion.

Where necessary, part of the agreed purchase price may be paid directly to the finance provider.

Any remaining balance payable to you will be calculated after the agreed finance settlement.

We will not knowingly complete a purchase that leaves undisclosed or unresolved third-party ownership rights.

8. Purchase Agreement

A vehicle purchase becomes binding when both parties have entered into a purchase agreement, subject to any conditions expressly stated in that agreement.

The purchase agreement will record the agreed terms of the transaction.

This will normally include:

  • Seller details.
  • Vehicle registration.
  • Make and model.
  • Vehicle identification number (VIN).
  • Recorded mileage.
  • Agreed purchase price.
  • Payment arrangements.
  • Relevant declarations.
  • Date of purchase.
  • Handover arrangements.

The agreement may be signed physically or electronically.

If there is any inconsistency between these website Terms and Conditions and a separately agreed purchase agreement, the purchase agreement will take precedence in relation to that transaction, subject to applicable law.

9. Payment

We normally make payment by electronic bank transfer.

9.1 Payment arrangements

The agreed payment method and timing will be confirmed before completion.

Unless otherwise expressly agreed, payment will be arranged at the time of purchase.

Bank processing times may vary depending on the financial institutions involved.

9.2 Completion of payment

We will not require you to release the vehicle before the agreed payment arrangements have been completed.

Where payment is made by bank transfer, you should confirm that the funds have arrived in your account before releasing the vehicle.

9.3 Payment details

You are responsible for providing accurate bank account details.

We may carry out reasonable verification checks to reduce the risk of fraud or incorrect payments.

9.4 Fees

Cheltenham Vehicle Buyers does not currently charge customers administration or transaction fees for selling their vehicles to us.

If any charge is introduced in the future, it will be clearly disclosed before the customer agrees to proceed.

We will not deduct undisclosed fees from an agreed purchase price.

10. Vehicle Collection

Where agreed, we may arrange to collect a vehicle from a suitable location.

Collection arrangements will be confirmed with the seller.

You must ensure that:

  • The vehicle can be accessed safely.
  • You have authority to release the vehicle.
  • Relevant keys and documents are available.
  • The agreed handover arrangements can be completed.

If collection cannot proceed due to unforeseen circumstances, we will work with you to arrange an alternative appointment where reasonably possible.

We will inform you in advance if a particular collection arrangement involves a charge.

11. DVLA Notification

When a vehicle is sold to Cheltenham Vehicle Buyers, the change must be notified to the Driver and Vehicle Licensing Agency (DVLA) using the appropriate process.

For vehicles purchased into motor trade stock, the relevant motor trader notification process should normally be used.

We may assist with completing the notification where appropriate.

The seller remains responsible for ensuring that the required notification is made, unless applicable law provides otherwise.

Both parties should retain suitable records of the transaction and any DVLA confirmation.

Vehicle tax does not automatically transfer with a vehicle sale.

12. Cancellation and Withdrawal

12.1 Before a purchase agreement

You may withdraw your enquiry or decline a valuation without charge.

You are not required to sell your vehicle simply because you have requested a valuation or arranged an inspection.

12.2 After a purchase agreement

Once a binding purchase agreement has been entered into, the rights and obligations of both parties will depend on that agreement and applicable law.

Neither party has an unrestricted right to cancel a completed transaction simply because they have changed their mind.

Where a dispute arises concerning material misrepresentation, ownership, payment or another contractual issue, the matter will be handled in accordance with the purchase agreement and applicable law.

Nothing in these Terms removes any statutory rights that may apply.

13. Website Use

Our website is provided to help customers obtain information about our services and submit vehicle valuation enquiries.

You agree not to:

  • Use the website for unlawful purposes.
  • Submit deliberately false or fraudulent enquiries.
  • Attempt to gain unauthorised access to our systems.
  • Interfere with the website’s operation or security.
  • Introduce malicious software.
  • Misuse automated systems in a way that disrupts our services.

We may restrict access where reasonably necessary to protect the website, our customers or our business.

14. Website Information and Availability

We aim to keep the information on our website accurate and up to date.

However, vehicle valuations and other information may change.

We do not guarantee uninterrupted website availability.

Occasional maintenance, technical issues or third-party service interruptions may affect access.

If our online valuation service is unavailable, customers may contact us by email.

Nothing in this section excludes responsibility for losses or failures for which we are legally liable.

15. Liability

We will exercise reasonable care and skill when providing our services.

Nothing in these Terms excludes or restricts liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of obligations that cannot lawfully be excluded.
  • Any other liability that cannot be excluded under applicable law.

We are not responsible for losses caused solely by inaccurate information supplied by a customer where we have acted reasonably and lawfully.

We will not be responsible for circumstances genuinely outside our reasonable control, except where applicable law requires otherwise.

Nothing in these Terms affects your statutory rights.

16. Privacy and Personal Information

We collect and process personal information in connection with vehicle enquiries and purchases.

This may include contact information, vehicle details, transaction information and payment details.

Information is handled in accordance with our Privacy Policy and applicable UK data protection law.

Please refer to our Privacy Policy for further information about:

  • What information we collect.
  • How we use it.
  • Who we share it with.
  • How long we retain it.
  • Your data protection rights.

17. Complaints and Disputes

We aim to resolve complaints fairly and promptly.

If you have a concern about a valuation, vehicle purchase or another aspect of our service, please contact us.

Email: sell@cheltenhamvehiclebuyers.co.uk

We will review your complaint and seek to provide a reasonable resolution.

Where a dispute cannot be resolved directly, the parties may agree to use mediation or another appropriate dispute resolution process.

Nothing in these Terms prevents either party from pursuing legal remedies available to them.

18. Changes to These Terms

We may update these Terms and Conditions to reflect changes to our business, services or applicable law.

The latest version will be published on our website.

Changes will not retrospectively alter an existing purchase agreement without the agreement of both parties or another lawful basis for doing so.

19. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, without restricting any mandatory legal rights available to consumers.
